 My samples were not worth 1 Million. This is my business loss which I would have done if these samples were not stolen. I flew from Hong Kong - Chicago - Miami. I got my custom and immigration clearance at Chicago and Custom people did sign a receipt to me that they have seen my business samples. that means my bag did arrive intact in USA at least up to Chicago. I took connecting flight, after 2 hours from Chicago to Miami. and the theft happened in between this time. My bag did arrived in Miami, 2 days after but was empty. I had an airline officer with me to check the bag and she saw that it was empty too. Do you still think I dont have any case against airline. I wanted to consult some lawyer who could take up my case on a sharing basis. but staying in Hong Kong I cant do much. can someone help me with this too?
A.Unfortunately you do NOT have a case against anyone. The above answers were all opinions, but however are incorrect. No matter the value of your items, you check them at your own risk especially anything of value. Since you state you are aware of the Contract of Carriage, you need to go back and read it. IT clearly states that the airline, Im assuming is United based on the routing, that they are not responsible for loss of commercial items, negotiable papers/securities or any item of value. Lawyer's will not even give you a second glance, you have no case as it is clearly outlined in their contract. Understandbly you are upset, but you have nowhere to turn other than get whatever compensation the airline may consider, which in all actuality, they dont have to consider any if you recieved the luggage, it would only be out of courtesy. The airline is responsible for the baggage getting to the destination, not its contents. Espeically going through Customs, the airline points its fingers to them and Customs points its fingers back at the airline. International For international travels, including the domestic portions, subject to the Warsaw Convention, the liability limit for delay, damage or loss is approximately $9.07 per pound ($20.00 per kg) for checked baggage and approximately $400 per passenger for unchecked baggage. Where the Montreal Convention applies, the liability of the UA Carrier for the delay, damage or loss to checked and unchecked baggage is limited to 1,000 Special Drawing Rights per passenger. United is not liable for damage to fragile items, spoilage of perishables, loss/damage/delay of money, jewelry, cameras, electronic/video/photographic equipment, computer equipment, heirlooms, antiques, artwork, silverware, precious metals, negotiable papers/securities, commercial effects, valuable papers, or other irreplaceable items and/or any item where a liability release was signed by the passenger.

The Warsaw Convention is an international convention which regulates liability for international carriage of persons, luggage or goods performed by aircraft for reward.

Originally signed in 1929 in Warsaw (hence the name), it was amended in 1955 at The Hague and in 1975 in Montreal. United States courts have held that, at least for some purposes, the Warsaw Convention is a different instrument from the Warsaw Convention as Amended by the Hague Protocol.

In particular, the Warsaw Convention:

  • mandates carriers to issue passenger tickets;
  • requires carriers to issue baggage checks for checked luggage;
  • creates a limitation period of 2 years within which a claim must be brought (Article 29); and
  • limits a carrier's liability to at most:
    • 250,000 Francs or 16,600 Special Drawing Rights (SDR) for personal injury;
    • 17 SDR per kilogram for checked luggage and cargo,
    • 5,000 Francs or 332 SDR for the hand luggage of a traveller.

The sums limiting liability were originally given in Francs (defined in terms of a particular quantity of gold by article 22 paragraph 5 of the convention). These sums were amended by the Montreal Additional Protocol No. 2 to substitute an expression given in terms of SDR's. These sums are valid in the absence of a differing agreement (on a higher sum) with the carrier. Agreements on lower sums are null and void.

On November 20, 2008, the exchange rate was 1.00 SDR = 1.176 EUR or 1.00 SDR = 1.472 USD.

A court may also award a claiming party's costs, unless the carrier made an offer within 6 months of the loss (or at least 6 months before the beginning of any legal proceedings) which the claiming party has failed to beat.

The Montreal Convention, signed in 1999, will replace the Warsaw Convention system, once Montreal has been ratified by all states. Until then, however, there will be a patchwork of rules governing international carriage by air, as different states will be parties to different agreements (or no agreement at all).
